By accessing or using our website, claimscafe.com (the “Site”), you agree to comply with and be bound by the following Terms and Conditions (“Terms”). Please read these Terms carefully before using the Site. If you do not agree to these Terms, you must not access or use the Site.
These Terms apply to all visitors, users, and others who access or use the Site. Our services are strictly intended for individuals who own property or represent property owners within the State of Florida.
NO PUBLIC ADJUSTER-CLIENT RELATIONSHIP
The information provided on this Site is for general informational purposes only and does not constitute professional, legal, or financial advice regarding insurance claims. Your use of this Site, including the submission of any forms, emails, property information, or damage photographs, DOES NOT create a public adjuster-client relationship between you and Claims Cafe Public Adjusters LLC.
A binding public adjuster-client relationship is only established when a formal, written Public Adjuster Contract is fully executed, signed, and dated by both an authorized representative of Claims Cafe Public Adjusters LLC and the policyholder or their legally authorized representative, in full compliance with Florida Department of Financial Services (DFS) regulations.
FLORIDA STATUTORY & REGULATORY COMPLIANCE
As a licensed Public Adjusting business entity in the State of Florida, Claims Cafe Public Adjusters LLC strictly adheres to Florida Statutes and the rules set forth by the Florida Department of Financial Services (DFS). Website users and potential clients are hereby advised of the following statutory requirements:
Fee Caps: The fees charged by a licensed public adjuster in Florida are strictly capped by state law. Under Section 626.854, Florida Statutes, fees are capped at twenty percent (20%) of the total insurance claim recovery amount for non-declared events. For claims resulting from an occurrence that the Governor declares a state of emergency, fees are strictly capped at ten percent (10%) of the claim recovery for any claim filed within one (1) year after the date of the emergency declaration.
Policyholder Right to Cancel: Pursuant to Section 626.854(7), Florida Statutes, any policyholder who enters into a written agreement with a public adjuster has the legal right to cancel the contract without penalty or obligation. This cancellation window is typically ten (10) business days from the execution of the contract, or enhanced cancellation periods during declared states of emergency. Any such cancellation must be submitted in writing.
No Legal Representation: Under Florida law, a public adjuster may not give legal advice or provide legal representation. If a legal dispute arises with your insurance company that requires a lawsuit, you may need to retain a licensed attorney.
INTELLECTUAL PROPERTY RIGHTS
The Site and its entire contents, features, and functionality (including but not limited to all information, text, software, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Claims Cafe Public Adjusters LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The “Claims Cafe Public Adjusters” name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company. You must not use such marks without our prior written permission. You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these Terms.
PROHIBITED USES
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

INDEMNIFICATION

GOVERNING LAW AND JURISDICTION
All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida, in each case located in Pinellas County, Florida. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
CHANGES TO THE TERMS
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
